Teen Health and the Law

Updated 10.05.07 The laws surrounding teens and health care can be vague and confusing. Depending on the situation, teens have the right to make some health decisions on their own. And confidentiality and consent laws vary widely depending on the age of the teen and the treatment needed.

The ACLU of Ohio publication, Your Health and the Law: A Guide for Teens (updated in 2007), addresses the confusing details of teen health care law in an understandable format.

The guide clarifies teens’ rights under Ohio and federal law to help teens and those who care about them -- parents, school counselors, and health care providers -- ensure that they receive the health care they need.

Legal explanations are accompanied by examples of situations teens might face, as well as Internet resources and social service agencies to consult for further information.

What’s Happening in Ohio

As a result of a court decision in the case Cincinnati Women's Services v. Taft , the law governing teens 17 and younger seeking abortions has changed.

Young women 17 and under are now required to obtain the consent of a parent, custodian or guardian in order get an abortion. If a parent will not consent to an abortion, the minor can seek a judicial bypass. The ACLU's teen health guide has been updated to reflect this change.
