Our Take on This Bill

While we recognize this bill is a “creative response” by opponents of existing drug testing bills tied to public benefits, the ACLU of Ohio believes that mandatory drug testing violates the Fourth Amendment’s protection against unreasonable searches, regardless of one’s standing as a legislator or receipt of public funds. HB 343’s drug testing requirement for officials and TARP recipients is an unnecessary and invasive expansion of law.
