All members of the Ohio General Assembly would be subject to mandatory drug testing, with refusing to submit to testing regarded as an automatic failure. Testing positive for drugs would result in additional testing, loss of leadership positions, and loss of compensation until tests are no longer positive.

Our Take on This Bill

While we recognize this bill is a “creative response” by opponents of existing drug testing bills tied to public benefits, the ACLU of Ohio believes that mandatory drug testing violates the Fourth Amendment’s protection against unreasonable searches. SB 267’s drug testing requirement for officials is an unnecessary and invasive expansion of law.
